Terms and Conditions

 

 

1.         The Contract between us

 

1.1       These are the conditions under which we, Spectrum Yarns Limited (t/a “Yarn Stories”) (company number 1142407) of Spa Mills, Slaithwaite, Huddersfield, West Yorkshire, England, HD7 5BB deal with you, our customer in relation to yarn (“the goods”) and to download knitting patterns (“the patterns”) through the website yarnstories.com.  They do not apply to any products sold through any other website which we may operate.

 

1.2       We must receive payment of the whole of any price for the goods which you intend to order before your order can be accepted. Once payment is received we will confirm that your order is accepted by sending an email to the e-mail address which you provide in the order form.  It is this email which is our acceptance of your order and which therefore brings into existence a legally binding contract between us.

 

1.3       In ordering from us, you confirm that you are not less than 18 years old.

 

2.         Goods to be supplied

 

            We will supply to you the goods and/or patterns described in the order which you place under the terms of condition 1.2.  We have a legal obligation to supply goods and patterns which conform to your order. Full details of the goods and patterns are set out on our website.

 

3.         Price

 

3.1       The price payable for the goods and/or patterns that you order are set out in our website and will be confirmed in the email which we send you under condition 1.2.

 

3.2       You will be required to pay extra for delivery of goods (including but not limited to any local taxes or import duties charged in the jurisdiction to which we deliver the goods) and it might not be possible for us to deliver goods to some locations. Our delivery charges and information relating to the delivery are set out in our website or will be confirmed to you by email as soon as they become known to us. 

 

4.         Rights for you to cancel your contract

 

4.1       You have the right to cancel your contract:-

 

(a)        for the order of goods (but not patterns) with us within 14 days; and

 

(b)        for the order of patterns at any time within 14 days PROVIDED THAT we have not emailed to you the pattern(s) in question. If you are sent the pattern in such 14 day period, you hereby acknowledge that (because the pattern cannot be effectively returned to us) the right to cancel your contract with us for the purchase of that pattern is lost.   

 

You do not need to give a reason for cancelling your contract nor will you have to pay any penalty. Your cancellation period will expire after 14 days from the date on which you acquire, or a third party whom you have nominated to receive the goods on your behalf acquires, physical possession of the goods.

 

4.2       In order to exercise the right to cancel contained in condition 4.1 you must first inform us at Spectrum Yarns Limited of Spa Mills, Slaithwaite, Huddersfield, HD7 5BB or alternatively by email to information@yarnstories.com of your right to cancel the contract by a clear statement (e.g. in a letter sent by post, fax or e-mail). You may use the model cancellation form which can be found [here], but this is not obligatory. If you purport to cancel a contract for a pattern and subsequently download it, the contract will be deemed not to have been cancelled and you will be charged for the pattern.   To meet the cancellation deadline, it is sufficient for you to send your communication concerning your right to cancel before the cancellation period has expired.

 

4.3       You have a right to ask us to allow you to cancel your contract for goods or patterns with us at any time if your credit card has been fraudulently used by a third party to make the order.

 

4.4       If you cancel your contract with us, we will reimburse to you all payments received from you for the goods in question, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling of the goods by you.  We will make the reimbursement without undue delay, and not later than:-

 

4.4.1    14 days after the day we receive back from you any goods supplied, or

 

4.4.2    (if earlier) 14 days after the day you provide evidence that you have returned the goods, or

 

4.4.3    if there were no goods supplied, 14 days after the day upon which we are informed about your decision to cancel this contract.

 

4.5       We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly requested another form of reimbursement in writing and we have agreed. In any event, you will not incur any fees as a result of the reimbursement.

 

4.6       You must send back the goods to us without undue delay and in any event no later than 14 days from the day upon which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

 

4.7       To avoid doubt, once you have been sent a pattern, it cannot be returned and you cannot cancel the contract.

 

5.         Cancellation by us

 

5.1       We reserve the right to cancel the contract between us if:

           

            5.1.1    we do not have enough stock to be able to deliver the goods you have ordered;                                                                                         

 

            5.1.2    we do not deliver to your area; or

 

            5.1.3    one or more of the goods or patterns you ordered was listed at an incorrect price due to a typographical error on our website or an error in the pricing information received by us from our suppliers or licensors.

 

5.2       If we cancel the contract between us under clause 5.1, we will notify you as soon as possible of that cancellation and re-credit to your account any sum which we have already debited from your credit card as soon as possible and, in any event, within 30 days of cancellation.

 

6.         Physical delivery of goods to you

 

6.1       We will deliver the goods ordered by you to the address you give us for delivery with your order.

 

6.2       Delivery will be made as soon as possible after your order is accepted.

 

6.3       We aim to deliver the goods which you order to you:-

 

            6.3.1    for deliveries within the UK, within 5 working days from the date your order is accepted;

 

            6.3.2    for international deliveries, within 10 working days from the date your order is accepted.

 

            However, if we fail to deliver the goods in question within those timescales, you will not be entitled to cancel the contract as a result unless condition 8.2 applies.  In particular, we will not be liable for any delays in deliveries due to the customs and import procedures of the country of delivery, or any failure by you to obtain the necessary licences, clearances or consents for us to export or import the goods.  You will be responsible for the payment of any import duty or such other tax or duty or other payments which might be necessary, and we will not be responsible to you for any delay in delivery caused by your failure to do so.

 

6.4       You will become the owner of the goods you have ordered when they have been delivered to you.  We will be the owner until that point. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss, damage or destruction.

 

7.         Patterns

 

7.1       You may order patterns either as a guest or through your account with us.   If you order as a guest, you will be sent an email with the pattern attached to it.   If you order through your account the pattern will be automatically made available on your dashboard.  You must log in using your password and username to access the pattern through your dashboard. In ordering a pattern you give your express consent to the relevant method of delivery.

 

7.2       You are authorised to use the patterns (and all items derived from them) only for personal use and not through any business which you or any other person may operate.  

 

7.3       You will be sent a pattern only once and you should take care, therefore, not to lose, damage or destroy it. 

 

7.4       The patterns contain intellectual property which belongs to us and/or our licensors.  This includes, but is not limited to copyright.  You may not reproduce any of the patterns in any capacity or by any means unless we expressly agree to it in writing.  You shall not, without limiting any of the previous provisions of this clause, modify, rent, lease, lend, distribute, sell or create any works which derive from the patterns and you must not exploit the patterns or any of them in any way which is not authorised.

 

7.5       Because of the nature of the patterns and the intellectual property rights which we and our licensors own in them, we reserve the right to change or suspend or remove or disable access to any patterns without notice.  We will not accept any liability for doing so.

 

7.6       You should be aware that, if you use any of the patterns in breach of our intellectual property or other rights or those of our licensors, you may be liable to both civil and criminal penalties. 

 

7.7       If you do use the patterns or any part of them in a way which infringes our intellectual property rights or the intellectual property rights of any other person, you will indemnify us in full against all loss which we suffer as a result. 

 

7.8       The patterns are guidelines only and we do not warrant that you or any other person will be able to produce items of any nature from them.  You will rely on your own ability in that regard.

 

8.         Liability

 

8.1       If the goods we deliver are not what you ordered or are damaged or defective or the wrong number of goods is delivered, you must let us know in writing at our contact address of the problem within 10 working days of the delivery of the goods.  If you do not let us know, you cannot return the goods to us and we will have no liability to you.

 

8.2       If you do not receive goods ordered by you within 30 days of the date on which you ordered them, you must let us know in writing at our contract address of the problem within 40 days of the date on which you ordered the goods.  If you do not let us know, you cannot return the goods to us.

 

8.3       If you notify us of a problem under this condition, we shall, at your option:

 

            8.3.1    deliver the correct quantity of goods to you;

 

            8.3.2    deliver replacement goods (where the goods are damaged or defective); or

 

            8.3.3    refund to you the amount paid by you for the goods in question in whatever way we choose.

 

8.4       Unless the law provides otherwise, we will not be responsible for any loss of profits, business or goodwill (or similar loss) which you may suffer because of any problem about which you notify us under this condition and we shall have no responsibility  to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 8.3.3.

 

8.5       You must observe and comply with all  of the regulations and legislation of the country of delivery which apply to that delivery including obtaining all necessary customs, import or other permits, licences or consents and/or paying any import duty (or such other payment which may be necessary). The import or export of our goods to you may be prohibited by certain national laws. We make no statement and accept no responsibility in respect of whether or not the export or import of the goods you purchase is so prohibited.

 

8.6       Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under any laws or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury caused by our negligence.

 

8.7       We will accept no liability for any loss caused by any item which you make by following a pattern.

 

9.         Notices

 

            Unless otherwise stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address as stated in condition 1.1 and all notices from us to you will be displayed on our website from time to time or (at our discretion) sent by us to the email address which you provide to us with your order.

 

10.       Complaints

 

10.1     If you have any complaints about the goods or patterns or any aspect of the way we have dealt with you the complaint should be made in writing to our contact address stated in condition 1.1

 

10.2     We will investigate any complaint you make as soon as we are able and in any event we will respond to your complaint in writing or by e-mail within 30 days of receiving your complaint.

 

11.       Events beyond our control

 

            We shall have no responsibility to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, among other possibilities, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

12.       Invalidity

 

            If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) then the remaining terms and conditions will remain enforceable and still apply.

 

13.       Privacy

 

            You acknowledge and agree to be bound by the terms of our privacy policy which is set out in our website.

 

14.       Third party rights

 

            Except for us and our affiliates, directors, employees or representatives and you, no person has any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the contract made between us and you. .

 

15.       Governing law

 

            The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

 

16.       Entire agreement

 

            These terms and conditions, together with our current website prices, details of goods, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf alters or supersedes these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

 

17.       Waiver

 

            We may waive any of our rights under our contract with you at any time and for any reason without affecting our ability to enforce that right or any other provision of that contract. 

 

18.       Colour Rendition

 

            Whilst we have made every effort to photograph and digitally portray colours of our yarns as accurately as possible, there can be a variation from the actual due to the type and calibration of your screen. If you have any doubts please order a shadecard. Of course there can also be small shade variations from dye lot to dye lot, as is normal with any yarn. We will always ensure that we only despatch orders where any individual colour comes from the same dye lot.

 

19.       Free Shadecard Promotion Terms & Conditions

 

19.1     All the above website terms and conditions apply to this promotion.

 

19.2     The free sample and shadecard request is open to residents of the United Kingdom only.

 

19.3     No responsibility will be accepted for any requests that cannot be met or are not received.

 

19.4     Yarn Stories may use your personal details to send you brand information and details of activities that they feel will be of interest to you. Your details will not be passed to any third parties, and you will be able to unsubscribe at any time.

 

19.5     Yarn Stories reserve the right to vary the terms & conditions or remove the free sample pack offering in the event of circumstances arising beyond its reasonable control.

 

19.6     Applicants will receive by post their free shadecard within a maximum of 10 working days from submitting the request form.

 

19.8     There are no cash or other alternatives available.

Hellador Pattern Competition Sept/Oct 2015 - Terms & Conditions

Entry to the Prize Draw is open to persons aged 18 or over excluding employees and their families of Spectrum Yarns or anyone professionally connected with this promotion. By entering this competition, you agree to us sending you more information about our products and services. Only one entry per person. Upon provision of their contact details participants agree to be entered into the Prize Draw. The promoter will not be liable for applications not received, incomplete or delayed. Last date for receipt of entries is 23.59 BST on 11th October 2015. All correct entries received by 12th October 2015, will be entered into a draw, and 1 winner will be selected at random. The winner will be notified within 7 days of the closing date.
